In June 2022, the new supermajority of the US Supreme Court handed down Dobbs v Jackson Women's Health Organization, overturning Roe v Wade and nearly fifty years of case law in which the right to an abortion was a controversial but settled feature of US constitutional law. As the lead opinion puts it, the power to regulate abortions is now returned to the people of each State and their elected representatives. This seminar explores how US constitutional law arrived at this point, the directions it might be headed in, and any lessons that can be learned in Australia.
